Our services

These Terms of Service apply alongside any such agreement.
Website packages — pay monthly
Our pay monthly website packages are provided on a minimum 12-month term. By agreeing to a pay monthly package you are committing to a minimum of 12 monthly payments. After the minimum term, the agreement continues on a rolling monthly basis until cancelled by either party with 30 days written notice.
Monthly fees are charged in advance. Failure to pay within 14 days of the due date may result in suspension of services. If you cancel within the minimum term, the remaining balance of the minimum term may become payable.
The website and all associated assets remain the property of Exist Digital until all outstanding fees have been paid in full.
Hosting services
We provide website hosting on Google Cloud infrastructure via Cloudways. We make reasonable efforts to ensure high availability but do not guarantee 100% uptime. We are not liable for losses resulting from hosting downtime caused by factors outside our control, including third-party infrastructure failures.
We perform regular backups but strongly recommend clients maintain their own copies of important content. We are not liable for data loss.
Limitation of liability
To the fullest extent permitted by law, Exist Digital shall not be liable for any indirect, incidental, consequential or punitive damages arising from your use of our website or services, including loss of profits, loss of data or loss of business opportunity.
Our total liability in connection with any services provided shall not exceed the total fees paid by you in the 12 months preceding the event giving rise to the claim.
Third-party services
Our services may involve the use of third-party platforms including Google Ads, Meta, Shopify, WordPress and others. Your use of these platforms is subject to their own terms and conditions. We are not responsible for changes to third-party platforms or their terms.
Governing law
These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
